| IRRC Review of Commission Gas Competition Regulations | |
| The Commonwealth's Independent Regulatory Review Commission issued a disapproval order of the Commission's gas competition rulemaking pertaining to the formulation of the gas price to compare, POR and capacity release. The IRRC, "determined this regulation is not consistent with the statutory authority of the PUC and the intention of the General Assembly. In addition, upon consideration of all of the other criteria of the Regulatory Review Act discussed above, we find promulgation of this regulation is not in the public interest." The IRRC based this determination on its finding that including SOLR costs in the PTC would be contrary to statute. IRRC also expressed concern that the regulations would not ensure that gas price information was presented to consumers in an understandable format. The full text of the Disapproval Order is available on the NEM Website. | |
