FERC Workshop on Uplift Payments in Energy and Ancillary Services Markets

As previously announced, FERC plans to hold a series of workshops on market rules and operational practices affecting price formation issues in energy and ancillary services markets operated by RTOs/ISOs. The first workshop on the issue of uplift payments has now been scheduled for September 8, 2014, beginning at 8:45AM at the Commission's DC headquarters. The workshop will focus on, "technical, operational and market issues that give rise to uplift payments and the levels of transparency. The workshop will also preview the scope of the remaining price formation topics of offer price mitigation and price caps, scarcity and shortage pricing, and operator actions that affect prices." Comment Sought on Renewal Notice Requirements for Combined Competitive Electric and Natural Gas Customers

The Commission issued a Tentative Order requesting comment on the issue of renewal notices for customers receiving both competitive electricity and natural gas supply service. Recent changes in electric consumer protection rules prompted the need to clarify the differing renewal notice requirements for electric and natural gas service for combined customers. Current natural gas disclosure rules require two notices to be sent to the customer — the first at about 90 days and the second at about 60 days prior to the expiration of a natural gas contract. Newly adopted electric disclosure rules require an initial notice to be sent 45-60 days prior to contract expiration and an options notice to be sent at least 30 days prior to contract expiration.

For consideration it is proposed that, "In instances where a customer is receiving both electric generation and natural gas supply service from the same competitive supplier and the terms for both services expire within 30 days of each other, it is acceptable to send two contract expiration notices that address both services. The timing of the two notices shall comply with the timeframes found in the natural gas disclosure regulations; 52 Pa. Code §62.75(g)(1) — one at 90 days and the second at 60 days. However, all other aspects of the electric regulations (52 Pa Code §§ 54.5 and 54.10) must be applied to the customer’s electric generation service." Comments are due July 29, 2014.
