| Substitute HB 6592 Introduced on Electric Marketing Practices | |
| Substitute HB6592 sets forth a number of provisions pertaining to electric marketing. It would:
1) establish a marketing code of conduct for electric suppliers pertaining to:
a) conduct of door-to-door sales;
b) a prohibition against deceptive sales and marketing practices;
c) a limit on early termination fees for residential customers of the greater of $100 or twice the estimated bill for energy services for an average month;
d) requiring the customer's express consent to material changes in contract terms or duration;
e) a customer that terminates or cancels a renewal contract not later than seven days after receiving their first bill shall not be charged a termination fee;
2) provide residential customers with a right of rescission running from "until midnight of the third business day after the latter of the day on which the customer enters into a service agreement or the day on which the customer receives the written notice from the electric supplier describing the customer's right to cancel service"; and
3) provide that electric customers with a maximum demand of not less than 100 kilowatts are eligible for direct billing from their supplier.

| HB 1276 Introduced on Door to Door and Multilevel Energy Marketing | |
| HB 1276 was introduced in the legislature this week and referred to the House Consumer Affairs Committee. The bill would prohibit gas and electric suppliers from charging a fee to "affiliated subsidiaries, employees, contractors, subcontractors, third-party marketers or third-party sales agent," for marketing activity undertaken on the supplier's behalf or for the purchase of marketing materials. Compensation for recruitment of representatives would also be prohibited. Gas and electric suppliers engaged in door to door marketing or multilevel marketing would be required to post security of $1,000,000 and file a certificate of liability with the commission. Suppliers would also be required to perform criminal background checks of "every employee, contractor, subcontractor, third-party marketer or third-party sales agent engaged in the sale or promotion of their energy supply service, including a check of the Megan's Law registry, prior to the individual's conducting door-to-door marketing or other sales activities."
